General Provisions
These conditions are valid exclusively between the company TESTA CONSERVE, with registered office in via Testa, 23 – 95126, Catania, Italy and any person making online purchases on the www.testaconserve.it website, hereinafter referred to as the ”CUSTOMER”. These conditions may be subject to change and the date of publication of the same on the website is equivalent to the date on which they enter into force. The CUSTOMER is obliged to comply with the terms set out in these conditions and is also obliged to periodically check this page for any changes to these conditions.
These conditions govern purchases made on the website www.testaconserve.it, in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Legislative Decree no. 206/2005, amended by Legislative Decree no. 21/2014 and Legislative Decree no. 70/2003 on electronic commerce.
Testa Conserve sells exclusively products of excellent quality. Access to and use of the Website, as well as the purchase of any product and/or service on the Website, are activities that presuppose the reading, knowledge and acceptance of these Conditions.
In particular, by sending an order through this Site, even in the event that the order is not processed, the customer expressly authorises TESTA CONSERVE, without any reservation, pursuant to article 13 of Legislative Decree no. 196/2003, to process his/her personal data for administrative and commercial purposes, and accepts the conditions listed on the specific page called “Privacy”, published on this same Site.
Therefore, anyone accessing and/or using services on the Site expressly agrees with Testa Conserve that the Site and these Terms and Conditions are governed by Italian law and subject to the exclusive jurisdiction of the consumer’s Court (see applicable law and competent court).
On the basis of these General Conditions of Sale, TESTA CONSERVE sells and the CUSTOMER purchases at a distance the goods indicated and offered for sale on the website www.testaconserve.it. The contract is concluded exclusively through the Internet, through the CUSTOMER accessing the address www.testaconserve.it and placing a purchase order according to the procedure provided by the site itself.
Before confirming the order, the customer undertakes to read these general terms and conditions of sale, in particular the pre-contractual information provided by TESTA CONSERVE and to accept them by ticking the box indicated.
Pre-contractual information for the consumer – Article 49 of Legislative Decree 206/2005
Before the conclusion of the purchase contract, the CUSTOMER takes note of the characteristics of the goods that are illustrated in the individual product sheets at the time of the CUSTOMER’s choice.
Before the conclusion of the purchase contract and before the validation of the order with “obligation to pay”, the CUSTOMER is informed about
– the total price of the goods including taxes, with details of shipping costs and any other costs;
– the method of payment;
– the term within which TESTA CONSERVE undertakes to deliver the goods;
– conditions, terms and procedures for exercising the right of withdrawal;
– information that the CUSTOMER will have to bear the cost of returning the goods in case of withdrawal.
TESTA CONSERVE declines all responsibility for the possibility that, due to a particular configuration of its computer or even a temporary malfunction, the colours of the photographed products or the characteristics displayed and described on the site may differ from the originals.
Product availability
Product availability refers to the actual availability at the time the CUSTOMER places the order. However, this availability must be considered purely indicative.
Even after TESTA CONSERVE sends the order confirmation e-mail, there may be cases where goods are not available. In this case, the order will be automatically rectified by eliminating the unavailable product and the CUSTOMER will be immediately informed by e-mail.
If the CUSTOMER requests cancellation of the order, terminating the contract TESTA CONSERVE will refund the amount paid.
The refund will be made using the same means of payment used by the CUSTOMER for the initial transaction, unless expressly agreed otherwise.
Payment methods
Any payment by the CUSTOMER may only be made by bank transfer, the credit cards indicated on the www.testaconserve.it website or through a verified Paypal or Stripe account.
We remind our new customers that your first order must necessarily be verified by the bank that issued your credit card. Our bank will then contact your bank so that your details can be confirmed before we can proceed with the shipment. This verification may cause a delay of a few days in the shipment of your first order. When purchasing on this Site, the Customer’s financial information (such as credit card number, expiry date, personal details) will be sent directly to the bank responsible for the payment transaction via encrypted protocol. Testa Conserve, nor any other party, shall ever have access thereto.
In order to place a purchase order on this Website, it is indispensable to:
– be 18 years of age or over
– be eligible to legally enter into binding contracts;
– have a valid e-mail address.
As soon as the payment is authorised (in case of payment by Credit Card or Paypal) or as soon as the amount of the transfer is materially credited to our bank account (in case of payment by bank transfer) and the items are available, the orders will be processed as soon as possible.
All sales prices of the products shown on www.testaconserve.it are in Euros and include VAT (where applicable). Shipping costs are not included in the purchase price, but are indicated and calculated at the conclusion of the purchase process before payment is made.
The CUSTOMER accepts the right of TESTA CONSERVE to change its prices at any time, however the goods will be invoiced on the basis of the prices indicated on the website at the time of creating the order and indicated in the confirmation e-mail sent by TESTA CONSERVE to the CUSTOMER.
In the event of price errors due to computer problems, Testa Conserve reserves the right to restore the correct price of one or more products and, if necessary, to grant the customer a full refund or – alternatively – the possibility of supplementing the amount in order to still receive the goods purchased.
Applicable law and competent court
These General Terms and Conditions of Sale are subject to Italian law.
Any dispute that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the Court of the place of residence or domicile of the CUSTOMER, if located in the territory of the State.
In any case, it is possible to have optional recourse to the mediation procedures referred to in Legislative Decree 28/2010, for the resolution of any disputes arising from the interpretation and execution of these conditions of sale by accessing the following website: https://webgate.ec.europa.eu/odr.
